Terms of Service

1. Acceptance of Terms

By accessing this website, purchasing our software products, or engaging our custom IT services, you agree to be bound by these Terms of Service, all applicable laws and regulations, and acknowledge your responsibility for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site or purchasing our services.

2. Scope of Services & Products

bindassTech provides professional IT consulting, custom software development, cloud infrastructure architecture, cybersecurity assessments, and commercial software products (including SaaS applications and developer utilities).

Specific terms, project milestones, deliverables, and service level agreements (SLAs) for custom engineering engagements are documented in individual Statements of Work (SOW) executed between bindassTech and the client.

3. Commercial Software Licenses

Upon purchasing a commercial software product license (e.g. bindassAPI Studio, bindassAuth Gateway, etc.), bindassTech grants you a non-exclusive, non-transferable license to deploy and utilize the software according to the purchased tier.

You may not decompile, reverse-engineer, redistribute, or resell the proprietary software code without prior written authorization from bindassTech.

4. Intellectual Property for Bespoke Services

For custom engineering engagements, upon receipt of full payment for completed milestones, 100% of custom intellectual property, bespoke source code, and assets developed exclusively for the client are transferred to the client.

5. Payment Terms & Invoicing

All fees for software licenses and service milestones are denominated in USD or INR as selected during checkout. Invoices are payable in accordance with the payment terms stated on each Statement of Work or checkout invoice.

6. Limitation of Liability

To the maximum extent permitted by applicable law, bindassTech shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services or products.
